Co-signing a mortgage or loan is a significant legal and financial commitment that carries substantial risk for the co-signer. Lenders and legal professionals often insist on Independent Legal Advice (ILA) to ensure the co-signer is making a fully informed decision. This process involves a private meeting with a lawyer who has no connection to the borrower or the lender, specifically to protect the interests of the individual assuming the liability.

The primary purpose of ILA is to ensure the co-signer understands that they are not merely a reference, but a joint debtor. In the eyes of the law and the lender, a co-signer is 100% responsible for the debt. If the primary borrower defaults, the lender can pursue the co-signer for the full amount without first exhausting all options against the borrower.
